Welcome to FashionPwr. These Terms and Conditions govern your use of our website (www.fashionpwr.com) and your purchases from our online shop and physical store located at Bokhållaregatan 1, Linköping, Sweden.

Fashion Pwr is a small business (enskild firma) located in Sweden, with the org. number: 901008-8327 and Moms/VAT number: SE901008832701.

2. Definitions

"FashionPwr," "we," "us," or "our" refers to the company operating the website www.fashionpwr.com and the physical store.

"Secondhand Items" refers to pre-owned fashion items sold directly by FashionPwr.

"Independent Items" refers to handmade, art, upcycled, or other creations sold by independent artists through our platform.

"Custom Orders" refers to items specifically created or modified according to customer specifications.

"Made-to-Order Items" refers to items that are produced only after an order has been placed.

3. Purchases and Payments

3.1. Secondhand Items: FashionPwr acts as the direct seller for all secondhand items available on our website and in our physical store.

3.2. Independent Items: For handmade, art, upcycled, and other creations from independent artists, FashionPwr acts solely as a platform connecting buyers and sellers. The independent artists are the actual sellers of these items and are responsible for their own sales, customer service, and compliance with applicable laws.

3.3. Pricing: All prices are listed in Swedish Krona (SEK) and include applicable VAT.

3.4. Payment Methods: We accept various payment methods as indicated during the checkout process. All payments are processed securely.

4. Secondhand Items

4.1. Condition Disclosure: Due to the nature of secondhand items, they may have small usage marks and minor defects. We do our best to accurately describe the condition of each item and disclose any notable defects in the item description.

4.2. Return Period: In accordance with EU consumer law, customers have the right to return secondhand items within 14 days of receipt without providing a reason.

4.3. Condition of Returns: All returned items must have their original tags intact. Items returned without original tags will not be accepted for return.

4.4. Return Process: To initiate a return, please contact us at returns@fashionpwr.com with your order number and the items you wish to return.

4.5. Refunds: Once we receive and approve your return, a refund will be issued to your original payment method within 14 days.

4.6. Return Shipping Costs: For secondhand items with small usage marks or minor defects that were disclosed in the item description, customers are responsible for the return shipping costs. However, if an item has a major defect that was not disclosed in the description, please contact us at returns@fashionpwr.com.

5. Custom Orders and Made-to-Order Items

5.1. Custom Orders: Custom orders are items specifically created or modified according to customer specifications. These orders require customer approval before production begins.

5.2. Made-to-Order Items: Made-to-Order items are products that are produced only after an order has been placed. These items typically have longer processing times than ready-to-ship items.

5.3. Production Timeframes: Estimated production times for Custom Orders and Made-to-Order items will be provided at the time of purchase. These timeframes are estimates and may vary.

5.4. Right of Withdrawal Exception: In accordance with EU Directive 2011/83/EU Article 16(c), the right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalized. Therefore, Custom Orders and Made-to-Order items cannot be returned unless they are defective or significantly differ from the agreed specifications.

5.5. Cancellations: Orders for Custom or Made-to-Order items can only be canceled before production has begun. Once production has started, cancellations cannot be accepted.

5.6. Deposits: Non-refundable deposits may be required for certain Custom Orders or Made-to-Order items. The deposit amount and terms will be clearly communicated before purchase.

6. Independent Artists and Their Items

6.1. Separate Terms: Each independent artist selling through FashionPwr has their own terms and conditions governing the sale of their items. These terms are accessible on the respective artist's profile page.

6.2. Limited Responsibility: FashionPwr is not responsible for the quality, safety, legality, or any other aspect of the Independent Items. Any claims, complaints, or inquiries regarding Independent Items should be directed to the respective artist.

6.3. Returns and Refunds for Independent Items: Return policies for Independent Items are determined by the individual artists. Please refer to the specific artist's terms and conditions for details.

7. Consumer Rights Under EU Law

7.1. Right of Withdrawal: In accordance with EU Directive 2011/83/EU, consumers have the right to withdraw from a purchase contract within 14 days without giving any reason, except for Custom Orders and Made-to-Order items as specified in section 5.4.

7.2. Legal Guarantee: All items sold by FashionPwr come with a legal guarantee of conformity as required by EU law. This means the items must be as described, fit for purpose, and of satisfactory quality.

7.3. Alternative Dispute Resolution: In case of disputes, EU consumers have the right to access the European Commission's Online Dispute Resolution platform at http://ec.europa.eu/consumers/odr/.

8. Delivery

8.1. Delivery Options: We offer various delivery options, including home delivery and pickup at our physical store.

8.2. Delivery Timeframes: Estimated delivery times are provided during checkout but are not guaranteed. We will make reasonable efforts to deliver items within the stated timeframe. Custom Orders and Made-to-Order items typically have longer delivery timeframes.

8.3. Risk Transfer: The risk of loss or damage to items passes to you when you or a third party designated by you (other than the carrier) takes physical possession of the goods.

9. Intellectual Property

9.1. Website Content: All content on www.fashionpwr.com, including text, graphics, logos, and images, is the property of FashionPwr or its content suppliers and is protected by copyright laws.

9.2. Independent Items: The intellectual property rights for Independent Items remain with the respective artists.

11. Limitation of Liability

11.1. For Secondhand Items: FashionPwr's liability is limited to the purchase price of the items in question, except where such limitation is prohibited by law.

11.2. For Independent Items: FashionPwr shall not be liable for any damages arising from the purchase, use, or inability to use Independent Items.

12. Changes to Terms and Conditions

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on our website. Your continued use of the website after changes constitute your acceptance of the modified terms.

13. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Sweden.
